Consumers File Class Action Against FitOn

FitOn, a leading digital fitness platform, is facing allegations that it unjustly shared consumers’ personal data with Meta and other third parties, tracking and sharing even the most minute details of their unique user experience—such as the videos they requested or obtained and the precise moment they pressed 'play' on that content from their devices. 

Dwoskin Wasdin represent FitOn users in a class action lawsuit, alleging that the fitness platform tracked user activity without consent, violating data privacy laws. 

The complaint, filed in the United States District Court for the Central District of California, claims that FitOn violated the federal Video Privacy Protection Act and certain California statutes by knowingly disclosing personal user data to various third-party marketing companies. FitOn is a fitness app where users can request and watch hundreds of fitness and wellness videos from their mobile app or web browser. 

According to the complaint, FitOn disclosed users’ video requests and viewing history every time they requested or watched video content on fitonapp.com, in violation of the VPPA and other statutes. The information was allegedly disseminated via hidden tracking technologies on the FitOn platform that send third parties information regarding FitOn users’ activity on the platform. Those third parties used this data, combined with data gathered about each user from other sources, for marketing and advertising purposes. 

The lawsuit seeks to recover damages incurred by FitOn users due to the company’s deceptive business practices and hold it accountable for those practices.
